InspectCam Terms of Service
Effective:
Please read this first: the level and Measure are rough checks. A phone is not a level or a survey tool. Do not rely on a reading alone for safety, building code, inspection, insurance or structural decisions. See section 2.
1. Who we are and what these terms cover
1.1 InspectCam is a camera app for documenting work. It is offered by InspectCam, a trade name (DBA) of Zeek LLC, a Washington limited liability company ("we", "us"). Our developer name on Google Play is Zeek Labs.
1.2 These terms cover:
- the free InspectCam app;
- Pro: the paid plans, the company account and its cloud storage;
- our web pages: "My files", the page to delete an account, the page where people send photos into a company's job, "Shared with me", and pages for reports shared by link.
A section marked Pro applies only to Pro.
1.3 "You" means the person using InspectCam. If you accept these terms for a company, you confirm that you may act for it, and "you" also means that company. Pro is for work.
1.4 You accept these terms when you tap a button beside a line that says so: when you start a company, a free trial or a plan, when you join a company, or when you send photos with a company's link. If you use only the free app, these terms apply to that use too.
1.5 Pro: You must be 18 or older to use Pro.
1.6 Google Play's own terms also apply to the app and to payments made through it. Google is not part of these terms.
2. The level and Measure are rough checks
2.1 The level, Measure, and every reading they give (for example an angle, a slope or a roof pitch) are rough checks. A phone's sensors are not a level, a square or a survey tool. Readings can be off, more so on small slopes. Do not rely on a reading alone for engineering, safety, building code, inspection, insurance or structural decisions. Check with the right tool before you decide.
2.2 A green line, a check mark, or the words "Level" or "Measured" only tell you what the phone read. They do not mean the work passes any code, standard or test.
2.3 You decide what a reading means and who you show it to. A photo that shows a reading shows only what the phone read when the photo was taken.
3. The free app
3.1 The free app is the camera. You may use it for free, also for your work.
3.2 We let you install and use the app on the devices you use. You may not sell it, rent it out, copy it for others, change it, or get around its limits.
3.3 Some features work only on some phones. The app is made not to show a feature that a phone can't use.
3.4 Parts of the app are open-source software, listed in the app under Settings > Open-source licenses. Nothing in these terms limits what an open-source license lets you do with the code it covers. For the libusb library in the app, under the GNU LGPL 2.1, that includes changing the app for your own use, such as running it with your own changed copy of libusb, and reverse engineering the app to debug those changes.
4. Pro: accounts and companies
4.1 Pro needs an account. You sign in with Google, or with a link we send to your email. Keep your sign-in to yourself. Tell us at once at support@inspectcam.app if you think someone else used it. You are responsible for what you, and the people you add to your company, do in InspectCam.
4.2 Every Pro plan belongs to a company account, even when one person uses it. The person who starts the plan is the owner.
4.3 The owner can invite people, up to the number the plan allows. The owner counts as one of them. People join as members, and the owner can make a member an admin. Everyone in the company sees the company's jobs, unless the owner or an admin limits a member to the jobs they are on. A member can delete only their own items. An admin can delete anyone's items, and can invite and remove members.
4.4 Only the owner can buy, change or cancel the plan, delete the company (4.7), or make or remove admins. Members and admins don't pay.
4.5 You can belong to one company at a time. While your own company has a live plan, you can't join another: cancel your plan in Google Play first, and join once it has ended. If you own a company with other people in it, you can join another company only after they have left or been removed, or after you delete your account (4.7). Time already paid for is not refunded.
4.6 When a member leaves or is removed, they can no longer reach the company's jobs in the cloud. What is already on their phone stays there: their own photos, videos and voice notes, and the company's jobs as they were on that phone. We can't remove it. What they may keep is between them and the company.
4.7 Deleting your account. You can delete your account in the app (Settings, Account, Delete account) or at files.inspectcam.app/delete. Download anything you want to keep first.
- If you are the owner and nobody else is in your company, the company is deleted too, with its copies in the cloud.
- If you are the owner and others are in your company, you can give the company to one of them, or delete it for everyone. Then members keep only what is on their own phones.
- If you are the owner, your plan stops renewing, also when you give the company to someone else. Time already paid for is not refunded.
- If you are a member, what you added to the company's jobs stays with the company: photos, videos, voice notes and notes. Your email and your details for reports go. Reports already made keep what they show.
- Files on your phone stay. Photos the app already removed from your phone after upload (11.3) are gone for good once their copies in the cloud are deleted.
Our privacy policy says what is deleted, what is kept, and for how long.
5. Pro: plans, prices and billing
5.1 Pro has three plans: Duo (up to 2 people), Team (up to 5) and Business (up to 10). The app shows what each plan includes.
5.2 You can pay monthly or yearly.
5.3 Prices. The app shows each plan's price before you buy, and Google Play shows it again before you pay. These terms do not list prices.
5.4 Billing. Pro is sold in the United States, in the Android app, through Google Play. Google Play bills your plan and adds sales tax where it applies.
5.5 Renewal. Your plan renews automatically at the end of each month or year until you cancel. Google Play charges the payment method on your Google account.
5.6 Cancelling. You can cancel at any time in Google Play. In the app, the owner's account settings have a link: "Manage or cancel in Google Play". Cancelling stops the next renewal. Pro keeps working until the end of the time you paid for. Then section 10 applies. If you can't use Google Play, email support@inspectcam.app from your account's email address, and we will cancel your plan.
5.7 Free trial. A company's first plan may start with a free trial. The app shows how long it lasts and the date it ends. Cancel before then and you pay nothing. If you don't, Google Play starts charging for the plan when the trial ends.
5.8 Failed payments. If a payment fails, Google Play tries again for a while, and Pro keeps working at first. If it still fails, Pro stops until the payment goes through. Nothing on your phone is deleted. If Google Play stops trying, Pro ends (section 10).
5.9 Changing plans. You can change plans in the app. A bigger plan starts at once. A smaller plan starts at your next renewal, and only when your company's people and files fit it. Google Play shows what it will charge before you confirm.
5.10 Price changes. A new price never applies to time you already paid for. If your plan's price goes up, you are told before it applies, with how to cancel. Google Play asks you to accept the new price. If you don't, your plan ends when your paid time ends.
5.11 Refunds. Google Play handles refunds under its refund policies. We refund the unused part of time paid for in two cases: when we close an account that did not break these terms (9.5), and when we stop offering Pro (17.3). We may also refund a charge that should not have been made.
6. Pro: storage
6.1 Each plan includes cloud storage for each person the plan allows. Everyone in the company shares the total. A free trial has less storage; the app shows how much. Photos, videos, voice notes, reports and files all count toward it.
6.2 The app shows the storage as a number of photos, with GB in brackets. The GB figure is the real limit (1 GB = 1,000,000,000 bytes). The photo count is an estimate. Bigger photos mean fewer photos.
6.3 The owner or an admin chooses the size at which the company's photos and videos upload. The phone keeps the full photo either way.
6.4 When storage is full, nothing is deleted, and you can keep taking photos and videos. New ones wait on your phone and upload once there is room.
6.5 Videos in jobs. A video in a job can be up to 2 minutes long. When you record inside a job, recording stops at 2 minutes. If you add a longer video to a job, it stays on your phone and does not upload. Videos you record outside a job are not affected.
7. Pro: limits
7.1 Each person can upload up to 10,000 files or 100 GB a day. Anything over that waits on the phone and uploads later.
7.2 Each month, the company can download up to as much as it stores. Past that, downloads slow down until the month ends. They don't stop. Reports, report pages and the app's own photo views don't count.
7.3 We limit how fast each person, each upload code and each visitor to our web pages can make requests. Something that makes requests too fast, such as a script, is slowed down.
7.4 Using Pro heavily within these limits is never on its own a reason to suspend or close an account.
8. Your content
8.1 We don't own your content: your photos, videos, voice notes, notes and reports, and the details you keep about your clients. What you add to a company's jobs may belong to you or to the company. That is between you and the company.
8.2 When you add content to a company's jobs, you let the company keep it, use it and share it for its work. This stays in place after you leave the company or delete your account.
8.3 You let us store, copy, resize, play and show your content, and let our service providers do this for us. We do this only to:
- run InspectCam for you and your company: for example to upload and keep your content, make smaller copies, and show it to your company and to anyone who has a link you make;
- keep InspectCam safe and look into misuse (section 9);
- follow the law.
This permission ends when the content is deleted from our systems, backups included, except where the law makes us keep it.
8.4 Your company decides what its people put in Pro, who in the company sees it, and what it shares. We keep and handle it for your company, as these terms say.
8.5 You are responsible for your content, and for having the right to collect, use and share it. That includes photos and recordings of your clients' property and of people, your clients' names and addresses, and any logo you add. If the law says you must tell the people it is about, or get their OK, you must do it.
8.6 Recording sound. Talk and video record what the microphone hears, not only your voice. Follow the recording laws where you work. In some states, such as California and Washington, everyone in a private talk must agree before you record it. If someone is talking with you, tell them you are recording, or stop. Don't use InspectCam to record people in secret.
8.7 Your workers. Your company sees what its people add to its jobs: photos, videos, voice notes and notes, who took each one, and, with the stamp, when and where. If the law where you work says you must tell your workers about this, or get their OK, you must do it. We don't do it for you.
8.8 Share links. If you share a report by link, anyone who has the link can open it, and hear its voice notes, without signing in, until the link is stopped, until its job is deleted for good (after the trash), or until the company's files can no longer be opened (section 10). You choose who gets it.
8.9 Links and codes for sending photos. If you give out a link or QR code, anyone who has it can send photos and videos into the job until you turn the code off. You choose where you put it. A trade who signed in sees the photos and videos you put in their trade's folder, unless you hide them from trades. If you turn on "Show the whole job", the people who sent photos to that job can see each other's photos. Turn it on only if they are fine with that. If you see something illegal, remove it and tell us.
8.10 Reports and report pages show your company's name. They also carry a small line at the bottom: "Generated with InspectCam".
8.11 We own the InspectCam app, its design and its name. You may use them only as these terms allow. You may use the reports and papers the app makes, with any wording the app supplies, for your work.
8.12 If you send us ideas (for example with "Suggest a feature"), we may use them freely. We owe you nothing for them.
9. Rules, and when we suspend or close an account
9.1 Don't use InspectCam to:
- store or share anything you have no right to, such as someone else's photos;
- store or share sexual images of children, or sexual images of anyone without their OK;
- threaten, harass, track, or secretly watch or record someone, or take photos or videos of people where they expect privacy, such as a bathroom or bedroom, without their OK;
- do anything else that is against the law;
- send viruses or other harmful code;
- get into another company's files, or test, break or overload our systems;
- get around our limits, payments or security, for example with a changed copy of the app;
- do something InspectCam is not made for, such as reselling it, or keeping or sharing large amounts of files that are not records of your work.
9.2 We may suspend or close an account at once, without warning, if we reasonably believe it is used for anything in 9.1, for fraud, or for automated or excessive use that harms the service or runs up its cost (7.4 still applies). Suspending an account stops access to Pro while we look into it. Closing an account ends it.
9.3 We may refuse service to anyone we reasonably believe has done, or plans to do, anything in 9.1 or 9.2. We never refuse service because of who someone is, such as their race, sex, religion, disability, or any other trait the law protects. If someone we refused buys a plan through Google Play anyway, we cancel it and refund it in full.
9.4 We may remove or block content that breaks these terms or the law, or that someone reports, while we look into it. We don't have to check content, but we may.
9.5 After we act:
- When we close an account, we stop its Google Play plan. We refund the unused part of the time paid for, unless the account broke these terms.
- Closing an account does not by itself delete its files. After we close an account, the owner may ask us within 30 days for a download of the company's files. We provide it, unless the law requires us to keep or withhold them, or giving them would put someone's safety at risk.
- While an account is suspended, the owner can still view and download the company's files, unless the reason is illegal content or a legal order. A suspension never starts the 30 days in 10.2.
- We email the owner what we did and why, unless the law, someone's safety or an investigation stops us. The owner can reply to ask us to look again.
- Where only one person in a company is involved, we may suspend that person alone.
9.6 Reporting. To report content or a person, use "Report content or a person" in the app's Settings (Pro), "Report this" on our web pages, or email support@inspectcam.app.
9.7 We report child sexual abuse material to the National Center for Missing & Exploited Children, as US law requires.
9.8 Sexual images shared without consent. To ask us to remove a sexual image of you that was shared without your OK, use "Report this" or email support@inspectcam.app. Sign your name, say where the image is, say it was shared without your OK, and tell us how to reach you. We act on it as fast as we can, and within 48 hours where the law requires it.
10. Pro: after Pro ends
10.1 Pro ends when the time paid for runs out after a cancel, when Google Play stops trying to take a failed payment, when Google Play refunds the plan and ends it, or when a free trial ends without a payment. A suspension is not Pro ending. (If the owner deletes the company, it ends at once, with no time to download: 4.7.)
10.2 From then, the company can download its files for at least 30 days. After that the files can no longer be opened. We delete them about 60 days after Pro ends, and only after we have emailed the owner a warning. Copies in our backups are gone within 30 days after that. We may keep files longer if the law requires it.
10.3 We email the owner when Pro ends, and again before the download window ends. The app shows the last day. If our warning goes out late, that day moves later. We don't end downloads or delete the files until we have emailed the owner a warning.
10.4 Nothing on your phone is deleted when Pro ends, and the free camera keeps working. Photos the app already removed from your phone after upload (11.3) are only in the cloud: download them before the window ends.
11. Pro: where your originals are
11.1 Full-size originals stay on your phone, in a folder you can open.
11.2 Uploading a photo makes a copy in the cloud, at the size your company chose (6.3). So does saving a report to your account. Neither moves or changes the original. Drawing on a photo doesn't change it either: your marks are saved separately.
11.3 Delete after upload. A setting can delete full-size photos from your phone once their upload is confirmed. It is off unless you turn it on, and it is offered only while your company uploads photos at full size. When it is on, the copy in the cloud is the only full-size copy of those photos, and section 10 applies to them.
11.4 Reports and report pages use smaller copies. A smaller copy never replaces an original.
11.5 While Pro is active, and during the window in 10.2, the company can download its files in the app or on a computer in "My files", within the limits of sections 7 and 9.
12. Sending photos with a link
12.1 A company can give you a link or QR code to send photos and videos into one of its jobs. You don't need an account.
12.2 You keep your rights in what you send. You let the company keep it, use it for its work (for example in reports for its client), and show it to the people working on that job. You let us store it and show it for the company, as section 8 says. The time and place stored in a photo go with it.
12.3 This stays in place after you delete your sign-in. What you sent stays in the job. To have something removed, ask the company, or use "Report this".
12.4 Send only what you have the right to send. Section 9 applies to you too.
13. Copyright
If you think something on InspectCam copies your work without your OK, write to our copyright agent: Copyright Agent, Zeek LLC, 12303 Cyrus Way, Suite 106, Mukilteo, WA 98275; phone +1 425-345-5028; support@inspectcam.app.
US law (17 U.S.C. 512(c)(3)) says your notice must have:
- your signature;
- the work you say was copied;
- where the copy is, for example a link;
- your address, phone and email;
- a statement that you believe in good faith the use is not allowed;
- a statement that the notice is true and, under penalty of perjury (it is a crime to lie in it), that you may act for the owner.
We may remove the copy. If we do, we try to tell the person who added it. They may send us a reply (a counter-notice) with what 17 U.S.C. 512(g)(3) asks for. Then we may put the copy back after 10 to 14 business days, unless the person who complained tells us they have gone to court.
In the right cases, we close the accounts of people who copy others' work again and again (repeat infringers).
14. No promises beyond these terms
14.1 We give you InspectCam and Pro "as is" and "as available". Apart from what these terms say, we make no promises about them. We do not promise that they will always work, work without mistakes, or keep every file. As far as the law allows, we give no promises the law would otherwise imply, including that they are fit for sale (merchantable), fit for your purpose, or do not break anyone's rights (non-infringement).
14.2 Stamps, figures and signatures. The stamp shows what the phone's clock and location said when the photo was taken. They can be wrong. We do not promise that a stamp is right, or that it proves when or where a photo was taken. A photo added from the phone's gallery is marked that way. Figures the app works out from what you type (for example amounts, dew point, grains per pound, equipment-days) are a help, not advice. Check them before you rely on them or give them to anyone. We do not promise that a signature taken in the app, or any wording the app supplies, is valid or enough for your purpose. If it matters, use your own wording and ask your lawyer.
14.3 Keep your own copies. Files can be lost, for example in an outage or a fault on our side or a provider's, or when a phone is lost before its photos upload. We do not promise a backup of your files. What you delete, or what the app deletes because you turned a setting on, may not come back. Keeping records for your license, your clients or the law is your job. Your own copies, on your phone or downloaded, are what protect them.
14.4 Nothing in these terms takes away a right the law gives you that a contract cannot take away.
15. Limits on what we owe
15.1 We are not responsible for indirect losses (losses that follow later from a problem): lost profits, lost business, lost or damaged data, or the cost of getting another service, even if we knew they could happen.
15.2 For all claims about InspectCam or these terms together, we owe at most the larger of: what your company paid for Pro in the 12 months before the claim, or US $100.
15.3 These limits do not apply to fraud; harm we cause on purpose; being very careless (gross negligence); death or injury caused by our negligence; anything else the law does not let a contract limit; or a refund these terms say we give. "Lost or damaged data" in 15.1 does not cover files we delete before the time section 10 gives. The limit in 15.2 still applies to them.
15.4 If someone makes a claim against us because of you. If someone (for example your client, a trade, or a person in a photo) makes a claim against us because of your company's content, how your company used InspectCam, or your company breaking these terms or the law, your company pays our reasonable costs of that claim. That includes lawyers' fees and any amount a court orders or a settlement you agree to. It does not cover any part of a claim caused by our breaking these terms or our own wrongdoing. We tell you about the claim, and you may help defend it.
16. Disputes
16.1 Which law. The laws of the State of Washington apply to these terms, without the rules that would choose another state's law. If you are a consumer, you also keep the protections of the law where you live that a contract cannot take away.
16.2 Which court. Apart from small claims (16.3), claims about InspectCam or these terms go to the state courts in Snohomish County, Washington, or to the federal court for that county (the Western District of Washington, in Seattle). You and we agree those courts may hear them.
16.3 Small claims court. You may always bring a claim in small claims court where you live, if the claim fits there.
16.4 Write to us first. If something goes wrong, please write to support@inspectcam.app first, and we will try to put it right. You don't have to wait for our answer: this never stops you from going to court, small claims court included, and it never changes a deadline.
17. Changes
17.1 Changes to these terms. We may change these terms. If a change matters to your plan, we email the owner at least 14 days before it applies, with how to cancel. If you keep your plan after that date, the new terms apply. If you don't agree, cancel before then. A change the law requires, or one that only adds something new, may apply sooner. A change to section 16 never applies to a dispute we already know about. Price changes follow 5.10. We post every version of these terms at inspectcam.app/terms/ with the date it applies from.
17.2 Changes to the app and Pro. We may add, change or remove features. Some may stop working on some phones. If we remove a main feature of your plan, we tell the owner, who may cancel.
17.3 If we stop Pro. If we stop offering Pro to everyone, we tell owners by email at least 30 days before, unless something outside our control (for example a provider ending its service to us) makes that impossible. Until then, owners can still download their files. We stop renewals and refund the unused part of any time paid for.
18. General
18.1 If part of these terms is struck down, the rest still applies.
18.2 These terms, with what the app shows before you buy, are the whole agreement between you and us about InspectCam. If you and we sign a separate written agreement about InspectCam, it wins where it differs. Google Play's terms cover your purchase from Google.
18.3 If we don't enforce part of these terms at once, we can still enforce it later.
18.4 We may transfer these terms to a company that takes over InspectCam, and we tell the owner. You may not transfer them without our OK, except that an owner who deletes their account may give the company to a member (4.7).
18.5 Things outside our control. We are not responsible for delays or failures caused by things we can't reasonably control, such as outages of the internet, Google or Cloudflare, power cuts, disasters or acts of government.
18.6 Sections 2, 8 (until your content is deleted), 10, 12, 14, 15, 16 and 18 still apply after these terms end.
18.7 A company may rely on what its people and senders let it do with their content (8.2 and 12.2) as if it had agreed these terms with them itself. Apart from that, only you and we have rights under these terms.
18.8 Parents: tools that limit what children see online are sold by many companies. The FTC lists some at consumer.ftc.gov/articles/how-use-parental-controls-keep-your-kid-safer-online.
